Terms of service
The agreement between you and Ergosy when you use the service.

The agreement
These terms apply when you create an account with Jesta Trading and use Ergosy. By creating an account you accept them.
Your account
You are responsible for what happens under your account and for keeping access to the email address you sign in with. Tell us straight away if you think someone else has access.
What we provide
We do our best to keep Ergosy available and working, but we cannot promise it will never be down. We will let you know in advance about planned maintenance whenever we can.
Paying
You pay per user per month, in advance, excluding VAT. You can cancel at the end of any month. We may change prices, and will tell you at least thirty days before that happens.
How we count and collect
You pay for the people in your workspace. On the first of the month we invoice everyone who is a member that day for the coming month, plus anyone who joined during the previous month for the days they were there — counted against the length of that month, with the day of joining included.
The invoice is the notice of the direct debit: we collect it three calendar days after sending it, from the account you authorised. Removing someone does not refund the month already invoiced; the month is settled, and you can cancel at the end of any month.
If a collection fails, we let you know and try again. Stays it unpaid, we may close the workspace — you can always export your data, also when it is closed.
Your data stays yours
Everything you put into Ergosy belongs to you. You can export it whenever you like. We use it only to provide the service, and we delete it when you ask us to.
Processing personal data
When you use Ergosy you are the controller of the personal data you put in, and Jesta Trading is the processor. Our data processing agreement sets out what we may do with that data, how we secure it, which subprocessors we use and how long we keep it. That agreement is part of these terms and applies from the moment you create an account, without you having to sign anything.

If we ever change the agreement in a way that matters to you, we will let you know at least thirty days in advance. The version that applied when you created your account keeps applying until then.
Ending it
You can close your account whenever you want. We may close an account that is used to break the law or to damage the service, after warning you where that is reasonable.
Liability
Our liability is limited to what you paid us in the twelve months before the problem arose. That does not apply to intent or deliberate recklessness on our side.
Which law applies
Dutch law. Disputes go to the competent court in the Netherlands.
